NHA-HLURB Contract Signing

On February 13, 2013, the Housing and Land Use Regulatory Board, through its Chief Executive Officer and Commissioner, Atty. Antonio M. Bernardo and the National Housing Authority (NHA) through its General Manager, Atty. Chito M. Cruz, signed the Contract for the purchase by HLURB the 4,897.50 square meter property within the NHA Compound which HLURB has been leasing from NHA since 1992. It is currently being occupied by the HLURB Central Office and National Capital Region Field Office.

IF THE number of existing developments registered with the Housing and Land Use Regulatory Board (HLURB) 7 is to be used as basis, Cebu’s skyline will be considerably different by 2015.

HLURB 7 Director Alixes Roy Lopez wants this vision made public by gathering all housing developers and participating in Cebu’s grandest festival–the Sinulog.

Lopez explained that since he assumed as HLURB 7 director, their office has performed well and that the agency and the developers want to honor the Sto. Niño this year by showing their unity.

HLURB 7, Megaworld, Filinvest Land Inc. and a group of 12 developers registered to be in the float category of this year’s parade. Lopez said this is the first time they will be participating as one group.

Though there will be four floats, they will be registering the float as one entry.

Lopez said the float will show what Cebu can be by 2015. “We will show the people what Cebu will be like in 2015.”

Lopez identified the areas surrounding Cebu IT Park, Cebu Business Park, Banawa, Guadalupe, Mabolo, South Road Properties, Fuente Osmeña and in the cities of Mandaue and Lapu-Lapu as the sections that will see the biggest transformations in two years’ time.

The idea was conceived last year and Lopez assured the cost to build the float is “minimal.” they had intended to join as a non-competing entity but they were advised to try their luck in the contest. However, Lopez assured winning was not the purpose for joining.

He said they want to communicate the vision of HLURB 7 by showing what Cebu can become at a venue where many can see it. Lopez said this is the start of a series of activities they will be holding as they want to launch a campaign that would make their vision and plans known.

AS cities and municipalities continue to grow, more local government leaders are starting to be conscious of the need for a comprehensive land use plan (Clup), Housing and Land Use Regulatory Board (HLURB) 7 Director Roy Lopez noted.

Lopez said they have also seen a more active participation from local government units (LGUs) after they began clustering their comprehensive land use planning workshops.

While only 15 LGUs participated in 2011, Lopez said they were able to sign up 93 municipalities in Central and Eastern Visayas to participate in their Clup assistance program this year.

In coming up with their Clup, Lopez said they allow the participants to come up with the land use plan themselves, while they only assist in the technical aspects. He described the sessions as a “democratic process” in a consultative and participative
environment.

“Everyone works on it. We give them inputs, but they are the ones who craft the plan.

We just guide them.”

Aside from seeing the need to have a Clup, Lopez believes the affordability of their Clup assistance program is also what attracts LGUs to join.

If done on its own, a fourth class municipality could spend up to P1.5 million to have a private contractor or hold a one-on-one session in conducting a Clup consultation.

He added that a highly-urbanized city could spend up to P2.5 million.

But under the clustering program of the HLURB, Lopez said, LGUs spend only about P360,000 for travel and accommodation expenses for participants for six months.

“Politicians are now conscious of its importance. They are very interested. We have seen attendance from officials like the mayors and vice mayors,” said Lopez.

Lopez said clustering the Clup is economical for LGUs and allows leaders to be conscious of their roles when it comes to land use planning.

He added that the National Government saw the effectiveness of the clustering program and decided to adopt the practice nationwide.

Lugawan sa Pabahay

The Housing and Land Use Regulatory Board-Central Visayas Region (HLURB-CVR) have organized and initiated the “Lugawan sa Pabahay” (pospasan sa pabalay in the local dialect), a feeding project for the street children and other less fortunate persons as an opening salvo for the forthcoming celebration of the Housing Month this coming October 2012. This is a joint undertaking with the Subdivision and Housing Developers Association of Region VII.

The said feeding project will commence on September 24, 2012 at 6:00 to 8:00 in the morning along Fuente Osmena Avenue, Cebu City beside Crown Regency Hotel and Towers. The succeeding ones are scheduled every Friday at 6:00-8:00 in the morning, all throughout the month of October.

It will be conducted at the different blighted communities found in the urban core of Cebu City which aims to serve around three thousand (3,000) beneficiaries.

This undertaking was jointly agreed during the Consultation Meeting with SHDA-CVR and HLURB REM Processors that took place at the Aquamarine Function Room of Sarrosa International Hotel, Kasambagan, Mabolo, Cebu City last September 21, 2012

HLURB Approves Cotabato City Land Use Plan

Vice President and concurrent Housing and Urban Development Coordinating Council (HUDCC) Chairman Jejomar C. Binay presented the CLUP certificate of approval to Mayor Japal I. Guiani, Jr. Also on hand during the CLUP presentation were HLURB Chief Executive Officer and Commissioner Antonio M. Bernardo, Commissioners Ria Corazon Golez-Cabrera, Luis A. Paredes and Linda Malenab-Hornilla, Ex-Officio Commissioners Augusto B. Santos of National Economic Development Authority (NEDA) and Undersecretary Jaime A. Pacanan of Department of Public Works and Highways (DPWH) and HUDCC Secretary General Cecilia S. Alba.A land use plan is a blueprint of a city or municipality, a sort of guide map that orderly disposes the land if it is for agricultural, residential, commercial, industrial, open space, a reserved “green” area (like forest land, swamp land, river or lake), a school, a transportation infrastructure, as well as other purposes that would enable communities within the territory to function properly, safely and productively.

It was the third time that Cotabato City’s CLUP was presented to the board for approval and ratification. The Plan was first brought before the board in August 2010 but was only given provisional approval to allow the city planning officials to shorten the term of the plan from twenty to ten years. It was the recommendation then by Vice President Binay who was apprehensive that the city would be restricted by the CLUP in case of a sudden upsurge in development. He said the only remedy is to revise the plan to suit the needs of the city.

In September 2011, the Board deferred approval of the city’s land use plan following the passage of a new law which mandated both the national and local governments to adopt a mitigating plan in response to said abnormal environmental condition. Vice President Binay took the occasion to require the city to incorporate disaster risk reduction and climate change measures in the plan. The delay in the approval of Cotabato City’s CLUP was deemed necessary in the wake of the massive flooding in the city caused by typhoon Dodong. Some 88,843 people had been reportedly displaced by the flood which started on June 07 and had affected a total of 25,375 families about half of the city’s total land area is considered to be below sea level but the water lilies that clogged the river tributaries of Rio Grande de Mindanao had worsened the inundation.

Mayor Guiani said several projects that would mitigate the negative effects of climate change have been identified and incorporated in the CLUP. To address the impact of climate change, the city had already undertaken several programs and projects such as riverbank protection/clearing and grubbing of riverways, rehabilitation of coastal marine ecosystem, expansion and improvement of perimeter dike system, establishment of materials recovery facilities and sanitation and sewerage facilities. He added that the city will undertake the following flood control and drainage programs: dredging of major-rivers, de-clogging and de-sitting of waterways, construction of flood control drainage system, formulation of drainage master plan and formulation of Mindanao River Basin.

Under the plan, Mayor Guiani said they will also identify and open new resettlement in Brgy. Tamontaka as well as new residential neighbourhood in Brgy. Kalangayan. He said that the construction of socialized housing units will be given priority under his administration.

Vice President Binay said he will discuss with President Aquino the perennial flooding problem in Cotabato City and the possibility of reviving the Task Force Mindanao River Basin to get the Local Government Units more involved in the solution process and harmonized the efforts of all concerned agencies or entities. He added that he will also consult the DPWH Secretary in the hopes of providing a long term solution to the city’s flood problems.

HLURB HITS THE MARK ON 2011 GOALS

The Housing and Land Use Regulatory Board (HLURB) performed better than expected in 2011 as it embarked on several programs that cut across its three major mandates composed of planning, regulation and adjudication.The HLURB, the government’s principal body for land use and housing development, is one of six Key Shelter Agencies (KSAs) under the aegis of the Housing and Urban Development Coordinating Council (HUDCC) concurrently chaired by Vice President Jejomar C. Binay.

During a recent Regular Board Meeting held at the Office of the Vice President (OVP), HLURB Chief Executive Officer Antonio M. Bernardo presented the accomplishments of HLURB in 2011 as well as its impact on stakeholders in the shelter sector. A total of 195 Local Government Units (LGUs) or 76% higher than the 111 LGUs targeted for the year have been assisted by the Board, in the preparation of their Comprehensive Land Use Plan (CLUP). The Comprehensive Land Use Plan and Zoning Ordinance defines the land uses, regulations, development strategies, proposed programs and projects addressing social, economic, infrastructure and climate change adaptation and disaster risk reduction.

As for CLUPs awaiting approval of the Board, a total of 360 LGUs or 188% higher than the 125 LGUs targeted for the year were assisted and monitored by the agency, which resulted to faster action on issues and problems encountered by municipalities and cities. HLURB has facilitated the approval of 77 CLUPs which have undergone review by Provincial Land Use Committee (PLUC) and Regional Land Use Committee (RLUC) where the Board also serves as a member.

The number of deputized Zoning Administrators supervised by HLURB has also increased by 40% or a total of 700 against a target of 500. The Board only deputizes zoning administrators for LGUs without approved CLUPs or Zoning Ordinances (ZOs).

A total of 1,344 LGUs and Homeowners Associations (HOAs) combined have increased their level of awareness on the Magna Carta for Homeowners and Homeowners Associations (HOAs) from numerous trainings, seminars and workshops conducted by HLURB.

A total of 784 residential projects have been issued License to Sell (LS) with 308,308 against a target of 166,500 dwelling units were licensed. While the increase in the number of licensed residential projects and units indicates a high demand for residential units, the government is also keen on addressing the problem of unoccupied dwelling units.

A total of 1,798 cases were handled by the HLURB which exceeded the target by 42%. For appealed cases, the Board scored a zero backlog as all cases on appeal before the Board that were ripe for resolution have been resolved or draft resolutions for which have been prepared and scheduled for deliberation by the end of 2011. HLURB will build on this success in its continuing effort to increase the confidence in the rule of law with the prompt resolution of appealed cases.

CEO Bernardo admitted however that there is a lot more to be improved particularly on the adjudication of regional cases. He expressed hope that the approval of the new rules of procedure and adoption of a legal monitoring system would accelerate the disposition of cases. He explained that instead of putting an absolute number as the target, the new monitoring system will continuously check the actual number of cases filed and how many were disposed by the HLURB.
The current HLURB Board is chaired by Vice President and concurrent HUDCC Chairman Jejomar C. Binay. Its full-time commissioners are Atty. Antonio M. Bernardo, concurrently HLURB Chief Executive Officer, Atty. Ria Corazon Golez-Cabrera, Atty. Luis A. Paredes and Atty. Linda Malenab-Hornilla while the ex-officio commissioners are DOJ Undersecretary Jose Vicente Salazar, NEDA Deputy Director General Augusto B. Santos, DPWH Undersecretary Jaime Pacanan and DILG Undersecretary Austere A. Panadero.
